Pernod to appeal Havana Club ruling
Pernod Ricard, the world's second-largest distiller, will appeal against
a court decision to allow Bacardi to sell rum under the Havana Club name
in the US.

The French company will take its case to the US Court of Appeals, saying
it "believes that this decision is legally and factually incorrect, and
that the continued sale of Puerto Rican rum under the Havana Club name
would deceive consumers".

Pernod and Bacardi have been battling over who controls the Havana Club
trademark in the US courts for 13 years. Both drinks companies produce a
rum called Havana Club, Bacardi sells its version in the US and Pernod
in the rest of the world.

Pernod says Bacardi's use of the name misleads consumers because its rum
is made in Puerto Rico. But a US judge ruled on Tuesday that the company
has not mislead the public because the bottles' labels clearly show the
rum is made in Puerto Rico, based on a recipe first used in Cuba in
1930, before Fidel Castro came to power. The US has had a trade embargo
on products from Cuba since 1962.

Bacardi says it bought the rights to the Havana Club trademark and rum
assets still owned by the founding Cuban family in 1997."
